Acceptance of Terms

By accessing and using the services provided by trustedpartner B.V. ("we", "our", "us", or "trustedpartner"), including our website and property investment and management services, you ("you", "your", or "client") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and trustedpartner B.V., a company registered in the Netherlands with registration number 99561832, having its registered office at Kastanjelaan 185, 2596 BD The Hague, South Holland, Netherlands.

Description of Services

trustedpartner provides professional property investment and management services, including but not limited to property sourcing and acquisition advice, property management services, portfolio analysis and optimisation, market research and analysis, tenant management services, maintenance coordination, and financial reporting and consultation services.

Our services are provided to individuals, companies, and institutions seeking professional expertise in property investment and management within the Netherlands and surrounding regions. Specific service details, scope, and fees are outlined in individual service agreements or contracts.

User Obligations

When using our services, you agree to provide accurate, complete, and current information as requested. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account or any other breach of security.

You agree to use our services only for lawful purposes and in accordance with these Terms. You shall not use our services to engage in any illegal activity, violate any applicable laws or regulations, infringe upon the rights of others, transmit harmful or malicious content, or attempt to gain unauthorised access to our systems or data.

You acknowledge that property investment involves financial risk and that past performance does not guarantee future results. You are responsible for making your own investment decisions and should seek independent financial advice where appropriate.

Service Agreements

Specific services are provided under separate service agreements that detail the scope of work, fees, responsibilities, and terms specific to each engagement. These Terms of Service apply to all such agreements unless explicitly stated otherwise in the specific service agreement.

All service fees must be paid in accordance with the terms specified in your service agreement. Late payment may result in suspension of services and additional charges as outlined in your specific agreement.

Intellectual Property

All content, materials, and information provided through our website and services, including but not limited to text, graphics, logos, images, software, data compilations, market analysis, reports, and methodologies, are the property of trustedpartner or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our intellectual property without our prior written consent, except as necessary for your personal use of our services as intended.

Any feedback, suggestions, or ideas you provide to us regarding our services may be used by trustedpartner without restriction or compensation to you.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Property investment involves inherent risks, and market conditions can change rapidly. While we strive to provide accurate and up-to-date information and professional advice, we cannot guarantee specific investment outcomes or returns. All investment decisions remain your responsibility.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

Limitation of Liability

To the maximum extent permitted by law, trustedpartner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising from or related to our services shall not exceed the amount of fees paid by you to trustedpartner in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so the above limitations may not apply to you in their entirety. In such cases, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless trustedpartner, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your use of our services, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms and any disputes arising from or related to our services shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

Any legal action or proceeding arising from or related to these Terms or our services shall be brought exclusively in the competent courts of The Hague, Netherlands, and you consent to the jurisdiction of such courts.

Dispute Resolution

We encourage you to contact us directly to resolve any disputes or concerns. If a dispute cannot be resolved through direct communication, we may agree to participate in mediation or alternative dispute resolution procedures before pursuing litigation.

Termination

Either party may terminate the service relationship at any time with appropriate notice as specified in the relevant service agreement. We reserve the right to suspend or terminate your access to our services immediately if you violate these Terms or engage in any conduct that we deem harmful to our business or other clients.

Upon termination, your right to use our services will cease immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, limitation of liability, indemnification, and governing law clauses.

Termination of services does not relieve you of any payment obligations incurred prior to termination.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "last updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

If you do not agree to any modifications, you must discontinue use of our services. It is your responsibility to review these Terms periodically for changes.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and trustedpartner regarding your use of our services and supersede all prior agreements, understandings, and communications, whether written or oral.
